L’expert n’exécute que des mandats pour lesquels il a la formation et les connaissances nécessaires. Il possède les techniques et respecte les réglementations utiles à la réalisation de ces missions, et/ou se fait assister par un spécialiste. Il doit parfaire et actualiser ses connaissances en permanence.

Quelle que soit la mission qui lui est confiée, l’expert ne peut en aucun cas aliéner ou restreindre même partiellement son libre arbitre, son indépendance professionnelle sur le plan moral, comme sur les plans scientifique et technique. Il restera à tout moment impartial.

L’expert ne peut répondre qu’aux questions rentrant dans la mission qui lui a été confiée et qu’il a acceptée. S’il est d’avis qu’une extension de cette mission est indispensable il doit la demander par écrit au juge ou à toutes les parties concernées.

Par extension l’expert ne peut révéler dans son rapport, que les faits directement liés à l’expertise et qu’il a découverts dans ce cadre. Il doit taire ce qu’il a pu apprendre à l’occasion de celle-ci hors des limites de son mandat.

L’expert doit s’abstenir de toute publicité directe dans les médias (presse, radio, TV), les revues techniques, les brochures de toutes sortes, etc., en relation avec sa qualité d’expert.

Il se limite, le cas échéant, à ne publier que des annonces à caractère administratif (recrutement de personnel, changement d’adresse, etc…)

L’expert s’interdit toute opération qui pourrait l’amener directement ou indirectement à recevoir d’un tiers intéressé commissions, remises, avantages ou dons quelconques, à l’occasion de ses missions.

L’expert, investi de ses pouvoirs par le juge ou les parties en litige en raison de sa qualification, doit remplir personnellement la mission qui lui est confiée. Dans le cas où certaines opérations d’expertise devraient être déléguées à des collaborateurs, il en assurera le contrôle permanent et direct. Ces opérations se dérouleront obligatoirement en son nom et sous sa responsabilité.

Lorsque plusieurs experts sont nommés dans la même affaire, ils doivent opérer conjointement. La rédaction du rapport doit être faite en commun. L’un des experts peut être chargé par les autres de préparer le projet du rapport. En ce cas, il s’efforce de présenter un texte reflétant fidèlement la pensée de ses confrères. Lorsqu’un expert ne croit pas devoir se ranger à l’avis des autres, il formule dans le rapport son propre avis.

L’expert déterminera ses honoraires avec tact et mesure.

En cas de collaboration entre plusieurs experts, la répartition des honoraires et frais se fera suivant convention préalable.

L’expert agira, en toutes circonstances, dans le respect de ses confrères et veillera, au cours de ses activités, à ne pas discréditer sa profession.

S’il est appelé à donner un avis motivé sur un point déjà soumis à un autre expert, voire à remplacer celui-ci dans des missions d’expertise, il est souhaitable qu’il se mette en rapport avec ce confrère.

Le non-respect de ce code de déontologie par un expert pourra être porté à la connaissance de la chambre des experts du Grand-Duché de Luxembourg sous forme de plainte d’un ou de plusieurs des intervenants, motivée, signée et adressée au président de la chambre ou au président de la section professionnelle concernée.

Ce dernier se chargera d’en informer le cas échéant les parties concernées et de porter le différend devant la commission de discipline prévue à l’article 39 des statuts de la chambre des experts.

En cas de reprise d’une expertise ou d’expertise complémentaire le second expert doit en informer son confrère.
